Will Obama stimulus plan affect private property rights?

With an enormous cash infusion expected from President-elect Barack Obama’s stimulus plan directed at new construction, what better time to get informed about one of the more acrimonious intermountain West legal brawls next to water rights — eminent domain.

Republican Lakewood city councilor Vicki Stack and state Rep. Jim Kerr will meet with residents today to discuss recently enacted property rights laws on eminent domain and compensation.

Kerr, also a Republican who represents HD-28 encompassing unincorporated southern Jefferson County, is a licensed residential property appraiser in the Jefferson County Assessor’s Office and small business owner.

In 2008, Kerr co-sponsored HB 1278 to place restrictions on the transfer or sale of land acquired by eminent domain by the Regional Transportation District. The property owner protection bill was postponed indefinitely.
